Types of Probation Violations in Michigan
Technical Violations
These are non-criminal rule violations, like missing appointments or failing to complete treatment. Michigan limits how much jail time you can face for technical violations under MCL 771.4b:
- Misdemeanor:
- 1st violation: Up to 5 days
- 2nd: Up to 10 days
- 3rd: Up to 15 days
- 4th or more: Up to the max for the original charge
- Felony:
- 1st violation: Up to 15 days
- 2nd: Up to 30 days
- 3rd: Up to 45 days
- 4th or more: Up to the max for the original felony
Non-Technical Violations
These include more serious actions, like getting charged with a new crime or absconding (disappearing). These can carry full revocation of probation and serious jail or prison time.
